Information on our responsibility:

You must have obtained the information about the violation to be reported in connection with your professional activity or in advance of a professional activity. It must also be a violation at the employer where you are or were employed or at another body with which you are or were in contact due to your professional activity. Information about private misconduct is not covered by the Whistleblower Protection Act.

Further information:

Your report will be processed confidentially. Under certain legal conditions, however, we may be required to disclose your identity to other authorities. This may involve requests from law enforcement authorities in criminal proceedings, orders in administrative proceedings following a report, including administrative fine proceedings, as well as court decisions.

The principle of confidentiality and the prohibition of reprisals are at the heart of the protection of whistleblowers. Therefore, please consider open communication with us. However, the Reporting Office also processes anonymous reports.

If you submit your report anonymously and do not provide a contact option, we will not be able to contact you in the further process if we have any queries or to inform you of the outcome of our investigation.

If you do not provide a contact option, you cannot claim that no appropriate follow-up measures have been taken or that you have not received any feedback on the taking of such follow-up measures in the event of a disclosure. Protected disclosure of information for these reasons is then not possible.

Please also note that the documentation of your notification is usually deleted three years after the procedure has been completed. After this time, documents from the proceedings will no longer be available as evidence.

Please note that the protection of the Whistleblower Protection Act, for example against reprisals for a report, only applies if you had reasonable grounds to believe at the time of the report that the information you reported was true. Deliberately providing false information can also result in criminal prosecution. You must therefore have factual evidence to support the assumption of a violation, for example because you noticed the violation yourself or made reliable inquiries. Pure speculation is not covered by whistleblower protection. Therefore, if possible, name all the evidence available to you (e.g. witnesses, documents, other records, photo files, etc.).
